FULL RELEASE OF ALL CLAIMS/INDEMNITY AGREEMENT

KNOW ALL MEN BY THESE PRESENTS, that I, the undersigned, on behalf of myself and any minor(s) under my care, for and in consideration of the continued authorization to participate in all volunteer activities and all related activities, and all activities incident to that said volunteer participation, have for myself, my heirs, executors, administrators, affiliates, predecessors, successors, parents, subsidiaries, assigns, servants, agents and employees and all other entities and persons of whatever type, along with their respective heirs, executors, administrators and assigns, agree to release and hold harmless EBSCO DEVELOPMENT COMPANY, INC., MT LAUREL TOWN MANAGEMENT, INC., MT LAUREL NEIGHBORHOOD ASSOCIATION, INC., and MT LAUREL MERCHANTS’ ASSOCIATION, INC. (“Indemnified Parties”) their heirs, executors, administrators, affiliates, predecessors, successors, parents, subsidiaries, assigns, servants, agents and employees and all other entities and persons of whatever type from any and all claims, demands, actions, causes of action, suits, costs, damages, expenses, compensation and liability of every kind, character and description, either direct or consequential, at law or in equity, which may arise out of participation in the activities for which the I have volunteered. This release shall be effective for any and all eventualities which may have at any time hereafter occurred, arising from, resulting from or in any manner incidental to any matter, thing or event occurring, or failing to occur, at any time in the past up or at the time of or after my volunteer participation. Further, I, on behalf of myself and any minor(s) under my care, agree to indemnify and hold harmless the Indemnified Parties, their heirs, executors, administrators, affiliates, predecessors, successors, parents, subsidiaries, assigns, servants, agents and employees and all other entities and persons of whatever type from any and all claims directly related to the settlement of my legal case.

I understand and agree that the Indemnified Parties, their heirs, executors, administrators, affiliates, predecessors, successors, parents, subsidiaries, assigns, servants, agents and employees and all other entities and persons of whatever type are not responsible for any injury or property damage arising out of the volunteer activities, even if caused by their ordinary negligence or otherwise. I understand that participation in the volunteer activities involves certain risks, including, but not limited to, serious injury and death. I am voluntarily participating in the volunteer activities with knowledge of the danger involved and I agree to accept all risks of participation. I understand that this document is intended to be as broad and inclusive as permitted by the laws of the State of Alabama and agree that if any portion of this Agreement is invalidated, the remainder will continue in full legal force and effect.

I also understand that this document is a contract which grants certain rights to and eliminates the liability of the Indemnified Parties, their heirs, executors, administrators, affiliates, predecessors, successors, parents, subsidiaries, assigns, servants, agents and employees and all other entities and persons of whatever type.

I enter into this agreement of my own free will, without force or coercion. At the time of entering into this agreement, the I am not under the influence of any medications or substances which would affect my ability to enter into this agreement. This document represents the entire agreement of the parties.

IN WITNESS WHEREOF, I have hereunto set me hand and seal to this Release of All Claims/Indemnity Agreement.
